A man in Nicholasville, KY, was fatally shot after allegedly attempting to break into a neighbor’s apartment while armed, following a domestic dispute. Police say the shooter claimed self-defense and has not been charged, though the case remains under investigation.

NICHOLASVILLE, KY (3-minute read) — A deadly shooting in a Nicholasville apartment complex has raised serious questions about self-defense, domestic violence, and legal boundaries in armed confrontations. Police say 24-year-old Raekwon Scott will not face immediate charges after fatally shooting James Milton, 31, during a Thursday morning altercation on Edgewood Drive.

Police Respond to Domestic Dispute Turned Violent

Officers arrived around 9:30 a.m. to find both Milton and his 54-year-old mother, Samantha Milton, suffering from gunshot wounds. James Milton had been shot at least twice in the chest, and his mother was hit in the arm. Both were rushed to the University of Kentucky Chandler Hospital, where James later died. Samantha was treated and released.

The confrontation reportedly began after Milton’s girlfriend entered Scott’s apartment. Police believe Milton, already agitated from a previous argument the night before, armed himself and attempted to break down Scott’s door.

Shooter Claims Self-Defense

Authorities say Scott remained on the scene and fully cooperated with investigators. Early findings suggest Scott fired in response to an armed intrusion. Samantha Milton is believed to have been unintentionally struck during the exchange.

Scott’s account is currently supported by evidence collected from the scene and statements from witnesses, who confirmed an ongoing dispute between Milton and his girlfriend leading up to the incident.

While no charges have been filed, the Nicholasville Police Department said they are continuing to review forensic evidence and autopsy results with the Commonwealth Attorney’s Office. An official determination on whether the shooting was legally justified will come after all evidence is analyzed.

Under Kentucky law, a person may use deadly force if they believe they are in imminent danger of death or serious injury, especially in their own residence. This legal protection, often referred to as the “Castle Doctrine,” could play a major role in whether Scott ultimately faces prosecution.

In any self-defense situation, being able to clearly articulate the threat and ensuring your actions align with state laws are crucial. Self-defense claims can be quickly undermined if a person uses excessive force or acts recklessly.
